Purchase and Delivery terms
1. Scope and Validity
1.1. Terms and conditions apply to purchase process between a person (the client) and e-commerece store emmaandtheo.ee (E-store).
1.2. In addition to these terms and conditions governing the purchase of products through the store legal relations arising from the legislation in force in the Republic of Estonia.
2. Products and Purchase process.
2.1. Product prices are in Euros and include the VAT of 20%
2.2. Product prices and availability are subject to change without notice.
2.3 To make an order please choose product/products and add them to shopping cart. Quantities can be changed in shopping cart later. To confirm and order please choose „Order“ Then we ask you to fill personal data sheet, choose delivery method and Payment method. Proceed with payment with chosen method. Order is confirmed by making the payment. Order confirmation will be sent by e-mail.
3. Payment for the products
3.1. You can choose from serveral options to pay for products:
3.1.1 Option to pay for orders via direct bank transaction (Estoian links Swedbank, SEB, Luminor, LHV, Coop) . Process is performed in secure bank environment.
3.1.2 Option to pay for order by creditcard in secure environment. For this transaction we use e SSL, MasterCard SecureCode, Verified by Visa solution.
3.1.3 Payments can be performed only in EURO currency.
Order will be processed as soon as the payment for the total invoice amount is received by the Merchant's bank account.
4.1. Emma and Theo is offering following otions for delivery:
Itella SmartPost parcel mashine, Omniva parcel mashine, Post package (outside Estonia) or pickup at Emma and Theo’s studio. Delivery time depends on service provider.
4.2. Client is obligated to enter correct contact details to avoid delays on delivery. Emma and Theo is not responsible for delays on delivery if contact information given by client is incorrect or inaccurate.
4.3 Delivery time is maximum 7 working days from the original order for products in stock. Delivery time for backorders and special orders should be agreed with Merchant.
5. Liability and Force Majeure
5.1. Merchant and Customer are responsible to each other violation of these terms to the other party for damage caused by the legislation in force in the Republic of Estonia.
5.2. Merchant shall not be liable to the Client for the damage or delay of delivery of the product, if the damage or delay is due to the fact that the merchant had no influence, did not foresee and could not foresee (force majeure). Merchant responsibility for the supply of goods for the ending time of delivery to the customer or the transport company
6. Other terms
6.1 Personal data collected while customer visits e-store and purchases products will be classified as private personal data. Emma and Theo will not transfer data to third parties.
6.2 Complaints and misunderstanding between Merchant and Customer will be settled through negotiations. If client is not happy with the result or result is not achieved the Client has the right to claim to Consumer Protection Agency or Harju County Court. Estonian and European legistlation is considered when negotiation over complaints.
Products purchased from our e-store can be returned within 14 days of the date of delivery. Option to return purchased goods does not consider goods bough directly from our studio. Product you want to return should be unused, in it's orignal package and labels attached.
To exchange or return products, you need to submit a request firstname.lastname@example.org
Merchand will transfer the purschase amount back to Customers bank account latest 14 days after reciving and examinating of returned product.
Delivery fees returning the product should be covered by customer. (Merchant will cover delivery fees only when product has defects or it is not what was ordered)
Products made to special order (special sizes, different from series products) are not subject to return!
