E-store purchase and delivery conditions

 

The owner of the e-shop www.emmaandtheo.ee (hereinafter e-shop) is Emma and Theo OÜ (registry code 12142633, VAT no EE101633596), located at Vardi tee 19a, Viimsi, Estonia.
 

Validity of the sales contract, goods and price information

 

The terms of sale apply to the purchase of goods from the e-store.

The prices of the products sold in the e-shop are indicated next to the products.

The prices of the products are in Euros and include 20% VAT.

A fee for the delivery of the goods is added to the price.

The delivery fee depends on the location of the buyer and the method of delivery.

The delivery fee will be shown to the buyer when ordering.

Information about the goods is provided in the e-shop directly next to the goods.


Placing an order
 

To place an order, select the product (s) you like and add them to the cart. You can add and remove products from the cart. To place an order, select "Order". Then please enter the customer's details, select the delivery method and payment method. Make a payment according to the selected payment method. The order is placed after the amount due has been received by the e-store. Order confirmation will be sent by email.

 

If the ordered goods cannot be delivered due to expiration of the goods or for any other reason, the buyer will be notified as soon as possible and the cost of goods (incl. Delivery costs) will be refunded immediately, but not later than within 3 working days of sending the notice.

Payment for products 

 

1. Possibility to pay for the goods via a bank link (Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop) 

2. Possibility to pay for the goods with a credit card in a secure payment environment. SSL, MasterCard Secure Code, Verified by Visa solution is used when requesting card data.

3. All the above payment methods can only be used to pay for the goods in Euros (EUR).

 The execution of the order will start from the moment the entire amount indicated on the invoice has been received in the current account of the e-store.

Delivery

Emma and Theo offers a variety of delivery options:

Itella SmartPost parcel machine, DPD parcel machine, Omniva parcel machine, Omniva parcel (outside Estonia) or the opportunity to pick up the goods yourself. The time of delivery depends on the terms of the service provider providing the delivery.


The buyer is obliged to check the correctness of the contact information provided before placing the order to avoid delays and misunderstandings during the delivery of the products. The e-shop is not responsible for delays in the delivery and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information provided by the buyer when placing the order.

E-shop will post the package usually within 1-2 working days.

Shipments within Estonia usually reach the destination specified by the buyer within 2-7 working days.  

The delivery time of “special orders” (products produced with special requirements after the completion of the order) will be agreed with the seller.

Return of the goods

Buyer has the right to return the goods within 14 days of receiving the parcel.  The goods to be returned must be in the original packaging, labelled and unused. The name of the customer and the order number must be attached to the returned goods.

The goods can be returned or exchanged free of charge through the parcel machine in which the package was ordered (see detailed instructions here). The goods can also be returned to Emma and Theo's studio at Vardi tee 19a, Viimsi, at a previously agreed time.     

In order to return the goods, the buyer must submit a written application and send it by e-mail to  info@emmaandtheo.ee , which includes the order number and the name of the customer. If desired, the buyer fills in the standard return form, which can be found here

Refund will be made upon receipt of the returned goods, but not later than 14 days after receiving the withdrawal application, all fees received from the buyer on the basis of the contract.

The e-shop may refuse to make refunds until the item which is the subject of the contract has been returned or until the buyer has provided proof (copy of the receipt or tracking code) that he has returned the item, whichever is earlier.

If the buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the e-shop, the e-shop does not have to reimburse the consumer for the cost that exceeds the cost related to the usual delivery method.

The e-shop has the right to withdraw from the sale transaction and demand the return of the goods from the buyer if the price of the goods in the online store is significantly lower than the market price of the goods due to a mistake.

Products made to special order (different sizes and different from series products ) are returnable! For example, if we make a product that we do not have in the online store.  

The right of withdrawal does not apply if the buyer is a legal entity.

If the buyer does not accept the parcel from the transport company or does not take the parcel out of the parcel machine or has provided incorrect information in the order and the parcel cannot be delivered, the transport costs will be borne by the buyer.

 

Complaints

 

The e-shop is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery and which becomes apparent within two years from the delivery of the goods to the buyer. During the first year of delivery of product, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the Online Store to rebut the respective presumption. The buyer has the obligation to contact the e-shop within two months (from the time the defect ia diacivered)  at the latest by sending an e-mail to info@emmaandtheo.ee .

If a defect is discovered, the buyer must take reasonable measures to preserve and protect the goods, including not using the defective goods if the use of the goods further worsens the condition of the goods.

The e-shop is not responsible for: the fault of the buyer for the deterioration / damage of the goods, for defects that have occurred as a result of irregular use of the goods, for the normal physical wear and tear of the goods in normal use.

 

The e-shop is not responsible for defects that have occurred after the delivery of the goods to the buyer. If the goods purchased from the e-shop have defects for which the e-shop is responsible, the e-shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the e-shop will return all fees associated with the sales contract to the buyer.

The e-shop responds to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.

 

 

 

 

Direct marketing and processing of personal data

 

The e-shop uses the personal data entered by the buyer (incl. Name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The e-shop transmits personal data to the companies providing the transport service in order to deliver the goods.

The e-shop will send newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.

The buyer can cancel the offers and newsletters sent to the e-mail at any time by notifying them by e-mail or by following the instructions in the e-mail containing the offers.

 

Solving arguments

 

If the buyer has any complaints regarding the e-shop, they must be sent to the e-mail address info@emmaandtheo.ee. If the buyer and the e-shop are unable to resolve the dispute , the buyer can turn to the Consumer Disputes Committee. The terms and conditions of the procedure are available and the application can be submitted at https://kiatt.ee/en. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the e-shop. The examination of the buyer's complaint in the commission is free of charge.
